Quality Jewellery Solutions Ltd is proud to be a member of the British Jewellers Association.

 "You" means the person placing an order.

"The contract is agreed" - by completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. An acceptance email from us confirms that the contract is formed.

"Working days" means all days other than Saturdays, Sundays and English statutory and public holidays.

By using the website to buy goods online, you confirm that you are at least 18 years old, or, if you are under 18, that you are accessing the website with the consent of your parent or guardian.

 

Ordering, cancelling before despatch and returning after despatch

 

Ordering

By completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Please note orders will only be despatched once payment has been received in full and cleared. We will not be liable if there is a delay, and we will not accept your order if payment is not authorised.

Certain steps must be followed for a contract to be formed, as described below.

After you have placed your order:

1.      We will send you, as soon as possible, an email to acknowledge your order. It will confirm which goods you have ordered. This email is not an order acceptance from us.

2.      When we despatch your goods, we will send you a confirmation email. This means we formally accept the order, and are obliged to complete the contract.

We do not have to accept your order, and for example, we will not accept your order if:

  • we do not have the goods in stock
  • your payment is not authorised
  • there is an error on our website regarding the price or other details of the goods
  • you have cancelled it in accordance with the instructions below

We reserve the right to refuse any order.

 

Cancelling an order before despatch

If you change your mind after placing an order, you can cancel it at any time before we despatch it. Please e-mail us at info@ringsbydesign.com. You will need to give us your name and address details, as well as the details of the goods you ordered.

 

Returning goods after despatch

 

Cooling off period

When you order from us online, you are entitled to a cooling off period after despatch, when you can return your goods without any penalty. Our cooling off period is 7 working days commencing the day following delivery, which includes any statutory cooling off period.

Certain items are excluded from the cooling off period guarantee, unless we are at fault. These are personalised or engraved items and pierced jewellery.

 

Returning goods

If you wish to return goods you have a duty to keep them in your possession and to take reasonable care of them until you return them. Goods must be returned in their original condition, including immediate packaging, within the cooling off period. Goods should be returned to Quality Jewellery Solutions Ltd, 53 Newbottle Street, Houghton Le Spring DH4 4AR either in person or by mail using the Royal Mail Special Delivery Service. You are responsible for meeting the costs of returning goods to us. If you wish to return the goods in person please telephone 0191 5843338 to agree a mutually convenient date and time to do so. |

Product availability

Our website only shows goods available for purchase in the UK, including Northern Ireland. We are unfortunately unable to despatch goods to addresses outside the UK, or in the Channel Islands.

 

Pricing and payment

Prices throughout the website are quoted in Pounds Sterling, and payment can only be accepted in Pounds Sterling. Prices include VAT. Packing and delivery costs will be added to the total price of your goods.

While we make every effort to ensure that the goods shown on our website are currently available at the price shown, we cannot guarantee that this will always be the case. If goods you have ordered are unavailable, you will be notified as soon as possible.

The price you pay is the price of the goods shown at the time you place your order, even if the price of the goods has since changed.

Goods can be paid for online using 'Paypal' or by sending a cheque to the registered office made payable to Quality Jewellery Solutions Ltd.

 

Delivery information

  • Goods are delivered using the Royal Mail 'Recorded' or 'Special Delivery' service. A signature is required upon delivery
  • If the parcel cannot be delivered because no one is available to sign for it you are responsible for contacting the Royal Mail to make alternative arrangements for delivery / collection. Any additional costs incurred as a result of alternative delivery arrangements must be met by you.
  • Goods can be delivered anywhere in the UK, including Northern Ireland. Unfortunately, we cannot deliver online orders to addresses in the Channel Islands or Eire.

When will I receive my order?

We will email you as soon as your order has been despatched. Special delivery parcels will normally arrive the next working day, Recorded delivery parcels can take up to five working days to arrive.

Please note that you will need someone to sign and accept delivery.

 

Faulty goods

The procedures, set out here, to return goods do not affect your statutory rights.

In the unlikely event you receive faulty goods please e-mail us at info@ringsbydesign.com  with details of your order and the problem with the item(s) within 7 working days of the day following the day the item(s) were delivered to you.

We will contact you within five working days of receiving your e-mail to agree an appropriate course of action.

This returns policy does not affect your statutory rights. Further information on your statutory rights can be found at www.consumerdirect.gov.uk.

 

Exclusions

Please note certain goods cannot be returned unless we are at fault. These are personalised or engraved items and pierced jewellery.

Terms & Conditions For Buying Goods Face To Face

 

By placing an order you are accepting these Terms & Conditions. Please read these Terms & Conditions before placing an order & retain a copy for future reference.

 

1.                   FORMATION OF THE CONTRACT

1.1                In these terms of sale the Seller shall refer to one of the entities whose name and address is set out below. (Please check at the time of your consultation which company / individual is licensed or authorised to use the Rings By Design brand in your geographical location.)

1.2                Subject to these terms and conditions you agree to purchase and the Seller agrees to sell the goods in accordance with the specification agreed between you and the Seller.

1.3                No contract exists between you and the Seller for the sale of any goods unless and until confirmed in writing by the Seller and you have paid your deposit to the Seller or its representative.  Once the Seller receives your deposit, (subject to the Seller's right of refusal as set out below) there is a binding legal contact between you and the Seller.

1.4                The Seller shall have the right, exercisable at its absolute discretion, to refuse to accept an order whether before or after accepting the deposit and shall inform you of any such refusal as soon as reasonably practicable and if a deposit has been accepted will return the deposit.

1.5                It is your responsibility to ensure that the Seller has the correct specification which accurately reflects the goods you wish to order.  By signing and returning to the Seller a quotation, job sheet or receipt you are deemed to have satisfied yourself as to the details of the goods you are ordering.  Any changes to the specification of your order, required by you after the acceptance of the order may result in an increase of the price of the goods, any such increase will be notified to you for confirmation before any specification alteration is accepted by the Seller.

1.6                The contract is subject to your right of cancellation set out below.

1.7                The Seller may change these terms of sale without notice to you in relation to future sales.

2.                   DESCRIPTION AND PRICE OF THE GOODS

2.1                The description and price of the goods you order will be as shown in the written quotation or the receipt for the deposit.

2.2                Where a written quotation is provided to you by the Seller the costs set out shall remain valid for up to 14 days from receipt by you of the written quotation.  After 14 days or the ?valid until' date stated on the written quotation, whichever is earlier, the Seller reserves the right to provide an adjusted price.

2.3                Every effort is made to ensure that prices quoted by the Seller are accurate at the time you place your order.  If an error is found the Seller will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. 

2.4                The price of the goods, are inclusive of VAT.

2.5                The Seller will use its best endeavours to supply you with the exact goods ordered but where this is not possible the Seller will notify you as soon as possible of any alterations to the design and specifications of the goods described in the order confirmation and where such alteration is fundamental to the goods ordered you may cancel your order for the goods and any deposit paid will be refunded.

3.                   PAYMENT

3.1                Payment for the goods can be made by cheque, and most credit or debit cards.

3.1.1           Unless already paid you shall immediately pay to the Seller the deposit for the goods which shall usually be 50% of the agreed sale price for the goods.

3.1.2           You will be required to pay the balance of the price of the goods on  your acceptance of the goods in accordance with Clause 5.1

3.1.3           Unless otherwise stated charges include delivery of the goods to your address.

4.                   DELIVERY

4.1                On receipt of your deposit the Seller will authorise the commencement of work on your goods.  If an estimated date of delivery is given, every effort will be made to deliver the goods by this date.  Time for delivery shall not be of the essence of the Contract unless previously agreed by the Seller in Writing.  The Seller will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. 

4.2                If the proposed date of delivery given is not acceptable to you, you will be required to notify the Seller in writing within three working days of receiving the proposed date of delivery.  The Seller will insofar as is reasonable attempt to arrange an alternative date of delivery.  

4.3                You will do all such things as the Seller may reasonably require to facilitate delivery of the goods and will reimburse the Seller any additional costs incurred by your failure to do so.

4.4                If there is no-one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.  If delivery is not made on an agreed delivery date, the Seller's additional delivery costs will be reimbursed.

5.                   Acceptance of the goods

5.1                On delivery of the goods you will immediately notify the Seller if you are not satisfied with and do not accept the goods. It is essential that you check the goods on delivery. If goods are delivered, damaged or faulty you must inform the Seller immediately.  If you do not inform the Seller immediately the Seller shall have no liability for goods said to be damaged on delivery.  This does not affect your statutory rights.

5.2                You will only own the goods once the Seller has received payment in full.

6.                   YOUR RIGHT OF CANCELLATION - BECAUSE goods are maufactured to customer's individual specifications we do not normally accept cancellations after an order has been placed.

6.1                You shall have the right to cancel the contract up to the end of seven working days after you pay the deposit, thereafter you have the right to cancel the contract at any time up to the date of delivery of the goods subject to the following payments:-

6.1.1           in the event that you exercise your right of cancellation up to the end of seven working days after you have paid the deposit you will be liable to pay the Seller 10% of the price of the goods ordered which will be deducted from the deposit which is returned to you;

6.1.2           in the event that you exercise your right of cancellation after the end of the seventh working day after signing the order confirmation but prior to the delivery of the goods the Seller may retain the full amount of the deposit paid.

6.2                We do not accept returns unless you comply fully with clause 5.1 and the item is found to be faulty, damaged, or has not been made to the agreed specifications after allowing for reasonable manufacturing tolerances.

6.3                To exercise your rights of cancellation you must give written notice to the Seller by hand, post, or e-mail, at the address or e-mail address shown below, giving details of the goods ordered and where applicable the order reference number and where applicable the necessary cancellation payments.

7.                   WARRANTY

7.1                All goods supplied by the Seller are warranted free from defects for 12 months from the date of delivery.  This warranty does not affect your statutory rights as a consumer.

7.2                This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Seller, failure to follow the Seller's instructions, any specification provided by you, or any alteration or repair carried out without the Seller's approval.

7.3                If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, you should notify the Seller in writing at the address or e-mail address set out below.

8.                   Exclusion of Liability

8.1                Nothing in these Terms and Conditions shall exclude or limit the liability of the Supplier for death or personal injury, however the Supplier shall not be liable for any direct loss or damage suffered by the Customer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price for the goods.

8.2                The Seller shall not be liable for any failure to perform any of its obligations to you where the failure is due to circumstances beyond the Seller's reasonable control, including, without limitation, Act of God, war civil disturbance, flood, lightening or fire, industrial action or lockouts, the act or omission of Government or any agent thereof, the act or omission of any person for whom the Seller is not responsible.

8.3                From time to time it may be desirable in order for the Seller to supply the goods, for the Seller to take possession of personal items of jewellery belonging to you, where this occurs you deposit such items at your own risk and you should ensure your goods are insured accordingly.  Whilst every care is taken, the Supplier cannot accept responsibility for the loss or damage to any of your personal items of jewellery.  Any liability shall be limited to the replacement cost of item of jewellery only.

8.4                The Seller will take all reasonable precautions to keep the details for your order and payment secure, but unless the Seller is negligent, the Seller will not be liable for unauthorised access to information supplied by you.

9.                   APPLICABLE LAW

These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.
